These Terms of Service ("Terms") govern your use of the DonzHit.me website, mobile application, and related services (collectively, the "Service") operated by DonzHit LLC, a Texas Limited Liability Company ("DonzHit," "we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms.
Nature of the Service. DonzHit.me is a community observation platform that enables users to document and share their personal observations of traffic and road-safety incidents. The Service does not investigate, verify, or certify user-submitted content, and nothing on the Service constitutes a legal determination, official record, or finding of fault, guilt, or liability regarding any person or incident.
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
The Service uses Google Sign-In for authentication. You are responsible for all activity that occurs under your account. You agree to keep your credentials secure and to notify us immediately of any unauthorized use. You may not share your account with or transfer it to any other person.
The Service allows you to submit two types of content:
You may also post comments and reactions on both Incident Reports and Street Talk Posts. All of the above are collectively referred to as "Content."
Ownership. You retain all copyright and other intellectual property rights in your Content. DonzHit LLC does not claim ownership of any Content you submit to the Service.
License Grant. By submitting Content to the Service, you grant DonzHit LLC and its affiliates, licensees, and authorized service providers a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license — and, to the extent your Content has already been publicly distributed through the Service or uploaded to a third-party platform on your behalf, an irrevocable license — to:
Scope and Duration. This license begins the moment you submit Content and continues for as long as necessary to fulfill the purposes described above. For Content that has been publicly distributed through the Service or uploaded to a third-party platform (such as YouTube) on your behalf prior to deletion, the license is irrevocable with respect to that distribution — DonzHit LLC cannot retroactively remove content already published on third-party platforms, and this license persists to the extent required to maintain that distribution.
No Compensation. You acknowledge that you will not receive any payment, royalty, revenue share, or other compensation for DonzHit LLC's exercise of the rights granted in this license.
Moral Rights. To the fullest extent permitted by applicable law, you waive any moral rights, rights of attribution, or rights of integrity you may have in your Content in connection with DonzHit LLC's exercise of the license above.
Deletion. You may delete your Content from the Service at any time through the app. Deletion removes your Content from the publicly visible Service. However, (a) backup and cached copies may persist for a limited technical retention period; (b) the license described above remains in effect with respect to any distribution that occurred before deletion; and (c) Content that was uploaded to YouTube or another third-party platform may remain on that platform subject to that platform's own terms.
Observational Nature of Incident Reports. Incident Reports represent the personal, subjective observations of the submitting user at the time and location described. Approval of an Incident Report by DonzHit administrators signifies only that the report meets the Service's content guidelines — it does not constitute a verification of the report's accuracy, a finding of fault or guilt, or a legal determination regarding any person depicted or described. Users are encouraged to describe what they personally observed using language that reflects the observational nature of their submission.
By submitting Content you represent and warrant that:
Incident Reports are reviewed by DonzHit administrators before being made publicly visible. Review is limited to confirming that a report meets the Service's content guidelines — it does not constitute an investigation into, or verification of, the events depicted. We reserve the right to reject, remove, or modify any Incident Report at our sole discretion, including reports that are off-topic, misleading, abusive, or otherwise inconsistent with the purpose of the Service.
Street Talk Posts and comments are published immediately upon submission by signed-in users. They are subject to community moderation: any user may flag a post for review. DonzHit administrators review flagged content and may remove it at their sole discretion. We reserve the right to remove any Street Talk Post or comment at any time without notice.
Users who repeatedly submit content that violates these Terms may have their access to the Service suspended or terminated.
No liability for moderation decisions. DonzHit LLC shall not be liable to you or any third party for any damages arising from our decision to approve, reject, remove, modify, or restrict any Content, or from any delay in taking such action, regardless of the basis for that decision. We reserve the right to modify, blur, redact, or otherwise alter Content in our sole discretion, including to protect the privacy of individuals depicted, to comply with applicable law, or to remove personally identifiable information submitted in violation of these Terms. Exercise of this right does not affect your representations and warranties regarding the original Content, nor does it create any obligation on our part to take any such action.

The Service provides a mechanism for users to flag Content they believe violates these Terms. Submitting a flag is not a guarantee of removal. DonzHit LLC reviews flags at its sole discretion and may resolve or dismiss them as appropriate. Abuse of the flagging system (e.g., mass-flagging for non-violating content) may result in suspension of your account.
Nothing on the Service — including Incident Reports, Street Talk Posts, comments, AI-generated analysis or commentary, DONZ reactions, or any other content — constitutes legal, insurance, law enforcement, traffic-safety, medical, or professional advice of any kind. You should not rely on any content published through the Service when making legal, insurance, or safety decisions. DonzHit LLC expressly disclaims any liability arising from your reliance on content published through the Service for any such purpose.
Incident Reports are personal observations of other users, not verified factual accounts, official records, or expert assessments. Any resemblance to official traffic or law enforcement findings is coincidental.
GPS coordinates associated with Incident Reports are provided by users and may be imprecise, incorrect, or intentionally approximate. DonzHit LLC does not verify the accuracy of location data and makes no representations regarding the precision or correctness of any location shown on the Service. You agree not to rely on location data from the Service for navigation, emergency response, legal proceedings, or any other purpose requiring precise or verified location information. DonzHit LLC is not liable for any loss, damage, or harm arising from inaccurate or missing location data.
The Service integrates with third-party services including Google Maps, YouTube, Firebase, and Google AdMob (advertising). Your use of those services is subject to their respective terms and privacy policies. DonzHit LLC is not responsible for the practices of any third-party service.
The Service displays third-party advertisements served by Google AdMob. We do not control the content of these advertisements. Ad preferences are managed through your device settings (iOS: Settings > Privacy > Advertising; Android: Google Settings > Ads).
The DonzHit.me name, logo, and all Service-related software, design, and text (excluding user-submitted Content) are the property of DonzHit LLC and are protected by copyright and trademark law. DonzHit™ and DONZ™ (including the DONZ robot character name and design) are trademarks of DonzHit LLC, with trademark registration pending. Unauthorized use of these marks is prohibited.
If you submit ideas, suggestions, feature requests, or other feedback about the Service ("Feedback"), you grant DonzHit LLC a perpetual, irrevocable, worldwide, royalty-free license to use, incorporate, and commercialize that Feedback in any way and for any purpose without restriction, compensation, attribution, or obligation to you. Feedback is provided voluntarily and DonzHit LLC is under no obligation to implement, acknowledge, or keep Feedback confidential.
DonzHit LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that Content on the Service infringes your copyright, please submit a written notice to our designated DMCA agent containing all of the following:

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing Content and notify the user who submitted it.
Counter-Notice: If you believe your Content was removed in error, you may submit a counter-notice to our DMCA agent containing: your signature; identification of the removed Content and its prior location; a statement under penalty of perjury that you have a good-faith belief the Content was removed by mistake or misidentification; your name, address, and phone number; and your consent to the jurisdiction of the federal district court for your district. Upon receipt of a valid counter-notice, we may restore the Content after 10–14 business days unless the complaining party seeks a court order.
Repeat Infringers: We will terminate the accounts of users who are repeat copyright infringers.
By using the Service and providing your email address, you consent to receive electronic communications from DonzHit LLC, including notices, disclosures, and other communications. You agree that any notices, agreements, disclosures, or other communications we send to you electronically (by email or in-app notification) satisfy any legal requirement that such communications be in writing.
DonzHit LLC is a provider of an interactive computer service as defined by Section 230 of the Communications Decency Act, 47 U.S.C. § 230 ("CDA"). We are not the publisher or speaker of any information provided by users of the Service, and shall not be treated as such for purposes of any civil or criminal liability. DonzHit LLC exercises no editorial control over user-submitted Content that confers publisher liability and is not responsible for Content created or submitted by users. No action taken in good faith to restrict, moderate, or remove Content that we consider objectionable shall cause DonzHit LLC to lose the protections afforded by the CDA or any analogous federal or state law.
Nothing in these Terms limits the CDA's protection of DonzHit LLC as an interactive computer service provider, and no user may assert a claim against DonzHit LLC that treats it as the publisher or speaker of user-submitted Content.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT SUBMITTED BY USERS OR GENERATED BY AI SYSTEMS ON THE SERVICE. WE MAKE NO WARRANTY REGARDING THE AVAILABILITY OR RELIABILITY OF ANY THIRD-PARTY SERVICE INTEGRATED WITH THE SERVICE, INCLUDING GOOGLE MAPS, YOUTUBE, FIREBASE, OR GOOGLE ADMOB.
DONZHIT LLC RESERVES THE RIGHT TO DISCONTINUE, MODIFY, SUSPEND, OR RESTRICT THE SERVICE OR ANY FEATURE THEREOF AT ANY TIME WITHOUT NOTICE OR LIABILITY TO YOU OR ANY THIRD PARTY. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DONZHIT LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DONZHIT LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100.00). THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY — CONTRACT, TORT, STATUTE, OR OTHERWISE — AND EVEN IF DONZHIT LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ANY CLAIM OR CAUSE OF ACTION ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE DATE THE CLAIM AROSE OR FIRST ACCRUED, OR BE PERMANENTLY BARRED, REGARDLESS OF ANY LONGER STATUTE OF LIMITATIONS THAT WOULD OTHERWISE APPLY UNDER APPLICABLE LAW.
You agree to indemnify, defend, and hold harmless DonzHit LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your Content; (c) your violation of these Terms; (d) your violation of any applicable law, including audio recording laws; (e) your violation of any rights of another person or entity; or (f) any claim by a third party — including any individual depicted in your submitted Content — arising from defamation, invasion of privacy, right of publicity, unlawful recording, or any other harm alleged to result from your Content.
DonzHit LLC reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with DonzHit LLC in asserting any available defenses.
DonzHit LLC shall not be liable for any delay or failure to perform its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, government action, civil unrest, power outages, internet infrastructure failures, third-party service provider outages (including Google Cloud, Firebase, or YouTube), or any other cause beyond DonzHit LLC's reasonable control. In such circumstances, DonzHit LLC's obligations are suspended for the duration of the force majeure event.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Common reasons for suspension include: submitting fraudulent or repeatedly off-topic Incident Reports, abusive behavior toward other users, or abuse of the flagging or DMCA systems. If you believe your account was suspended or terminated in error, you may contact us at legal@donzhit.com to request a review. We will consider appeals but are under no obligation to reinstate access. Accounts that have been inactive for more than 36 consecutive months may be subject to deletion at our discretion, with reasonable advance notice where practicable.
You may stop using the Service at any time. Sections 3, 7, 11, 12, 13, 15, 16, 17, 18, 21, 22, 23, 24, and 26 of these Terms will survive any termination.
Informal resolution. Before initiating any formal proceeding, you agree to contact us at legal@donzhit.com and provide a written description of the dispute and your desired resolution. We will attempt to resolve the dispute informally within 30 days.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions about their existence, validity, or termination — shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as stated below. The arbitration will be conducted in English, and the arbitrator's award will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction. You can obtain AAA rules and filing instructions at adr.org.
Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Class action waiver. YOU AND DONZHIT LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only on an individual basis and may not consolidate more than one person's claims.
Opt-out. You may opt out of binding arbitration by sending written notice to legal@donzhit.com within 30 days of first accepting these Terms (or within 30 days of the effective date of this provision for existing users, whichever is later). Your notice must include your name, account email address, and a clear statement that you are opting out of arbitration. If you opt out, disputes will be resolved in the courts described below.
Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. To the extent court proceedings are permitted under this section, you consent to exclusive jurisdiction and venue in the state or federal courts located in Texas.
No failure or delay by DonzHit LLC in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. A waiver of any breach or default does not constitute a waiver of any subsequent breach or default.
You may not assign or transfer these Terms or any of your rights or obligations hereunder, by operation of law or otherwise, without DonzHit LLC's prior written consent. DonzHit LLC may freely assign or transfer these Terms, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, without your consent. These Terms will bind and inure to the benefit of the parties and their permitted successors and assigns.
Nothing in these Terms creates or implies any agency, employment, partnership, joint venture, or franchise relationship between you and DonzHit LLC. You have no authority to bind DonzHit LLC to any obligation.
The Service may be subject to U.S. export control laws, including the Export Administration Regulations. You agree not to export, re-export, or transfer, directly or indirectly, any component of the Service or any related technical data in violation of applicable U.S. export laws and regulations. By using the Service, you represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force. If the class action waiver in Section 21 is found unenforceable, the entire arbitration agreement in Section 21 shall be null and void. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DonzHit LLC regarding the Service and supersede all prior agreements.
We may update these Terms from time to time. When we do, we will update the effective date above. For material changes, we will notify users by in-app notice and, where practicable, by email to your registered address at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the Service before the effective date of the changes.
DonzHit.me is both a community observation platform and an entertainment application. All Incident Reports and Street Talk Posts published through the Service represent the personal, first-hand observations of the users who submit them. DonzHit LLC:
No content on the Service — whether user-submitted, administrator-approved, or AI-reviewed — constitutes a legal determination, official record, law enforcement communication, or finding of fault, guilt, or liability regarding any person or incident.
DONZ Entertainment Commentary. The Service features DONZ, a fictional AI robot character who delivers sardonic, satirical one-liners associated with approved Incident Reports. DONZ commentary is AI-generated satirical entertainment — opinion and humor attributed to a named fictional character, not a factual statement by DonzHit LLC. DONZ commentary: (a) is not a representation of fact; (b) does not constitute evidence of fault, liability, or wrongdoing; (c) is not a legal determination or official finding; and (d) is protected expression under applicable law as clearly labeled satire and opinion from a fictional character. Any resemblance between DONZ commentary and the views of DonzHit LLC, its officers, or employees is coincidental. AI-generated reaction text, classification, or commentary is produced automatically and does not represent the opinion of DonzHit LLC or constitute evidence of any kind.
